Data licensing for law firms: what to consider
Privilege and confidentiality come first. Here is how to think about it.
Law firms are a special case. Much of what they hold is privileged or confidential, and professional rules apply.
What is usually off limits
Client communications, case files and work product tied to client matters are generally protected and should not be licensed.
What might be considered
Some firms have internal operational records, such as practice management processes and administrative workflows, that are separate from client matters. Whether any of it can be licensed is a question for your ethics counsel.
Proceed carefully
This is not legal advice. Any law firm considering data licensing should get a formal opinion first. Sakuya will not include material your counsel has not cleared.
